Killing near Douglas County Line

Last Thursday afternoon, Charles Kyger of Christian County met Ernest Hall, a Deputy Sheriff of Douglas county near the line, when an altercation came up over previous troubles and in which Kyger shot and almost instantly killed Hall, Kyger went to the home of George Tippen and had the sheriff called and gave himself up. He was brought to Ozark and placed in jail Thursday night, but owing to feeling aroused against him, his friends asked that he be removed to some other jail, which was done Friday by Sheriff E. M. Bishop by taking him to Springfield where he was kept until Tuesday, the day of the preliminary hearing before Justice D. F. Burgess of Ozark. From the evidence given, a little 9-year-old son of Hall’s was the only eye witness to the killing and he testified that they met and after an insulting greeting by Kyger he turned and followed Hall down the road about 200 yards , when a few words were spoken, but almost before the boy knew what was happening, Kyger fired two shots and killed his father. The boy also testified that his father had a gun and pulled it out of his shirt front, but did not fire. Others testified that they had heard Kyger threaten the life of Hall, if he (Hall) tried to find any whiskey he had hidden. It also developed that there had been hard feeling between them over a suit in court wherein a brother of Hall’s and a sister of Kyger had a suit over the legitimacy of a child. At the conclusion of the hearing, Justice Burgess held the prisoner to appear at Circuit Court and fixed his bond at $15,000, which had not been given Tuesday after the preliminary, some $8,000 of this amount having been qualified for by parties of the east part of the county and Douglas county. He was remanded to jail pending the outcome of his efforts to complete the bond. Kyger was represented in the preliminary hearing by Tom R. Moore and F. W. Barrett.
